Development Plans
The Development Plans section is responsible for the
formulation and implementation of the Council's land use planning
policies. These are set out in a number of planning documents which
can be accessed using the menu on the left.
The planning system in England and Wales is structured on
plan-led system to help control development in the area. Planning
policy is about how we plan for and make decisions about
development across Malvern Hills District.
The Council's adopted planning policies are set out in the
Malvern Hills District Local Plan which was adopted on 12th
July 2006. The local plan provides the basis for the
Council's actions, as a local planning authority, determining
policy on such matters as the distribution of housing and
employment and the conservation of the built and natural
environment.
There are transitional arrangements which provide for the
Malvern Hills District Local Plan to operate as part of the
District's Local Development Framework whilst the new system is put
in place. Further information can be found using the menu to
the left.
The Local Development Framework
The Planning and Compulsory Purchase Act 2004 introduced a new
planning system - the Local Development Framework.
To accord with the 2004 Act and
national policies set by Communities and Local Government
(CLG). The Development Plans team are preparing plans
that set out what can be built and where as well as policies to
protect the natural and built environment and deliver good design.
Under 2004 Act, there are two main levels of plan:
-
The Regional Spatial Strategy - The West Midlands
Regional Planning Body (comprising of representations from local
authorities within the region) prepares the Regional Spatial
Strategy and sets out what development and the type of development
is needed to meet the future needs of people in the West Midlands
region;
-
The Local Development Framework is prepared by Malvern
Hills District Council and is a folder of documents that sets out
how the local area may change over the next few years. Further
information about this can be found under the Local Development
Framework section;
It should be noted the coalition Government intends
to abolish Regional Spatial Strategies via the Localism Bill.
The Bill has so far passed the Committee Stage in March
2011 and will now progress to the Report Stage and Third
Reading. The Bill will then move to the House of Lords
and thereafter a period of consideration of amendments before
gaining Royal Assent in early 2012.
