What Is Backdating?

Benefit is normally paid from the Monday following the date that an application form is received in this office or any other designated office e.g. Jobcentre plus

There is a provision to backdate benefit for a maximum of:

• six months if you are working age (under 60)
• three months if you are pensionable age (over 60)

When Can Benefit Be Backdated?

To be considered for backdating you must show good reasons why you did not claim earlier and that you were unable to claim throughout the whole period that you are requesting backdating for.

Reasons  for being unable to claim could be:

• you were unwell
• you were in hospital
• you were unavoidably away from home

This list is not exhaustive as each request is based purely on the individual circumstances of the applicant.

How To Apply for Backdating

You must make a request for backdating in writing.

This can be in the form of a letter, or if you are completing a Housing and Council Tax Benefit application form  (248.61 KB) section 16 of this form gives you the opportunity to apply.

What Happens Next?

We will look at your request and write to you with our decision. We aim to make our decision within 14 days of your request although it may take longer at busier times.

If we refuse to backdate your claim you have the opportunity to pursue a formal appeal which must be requested in writing.
