Hanley Castle Neighbourhood Plan (Review) Regulation 16 Consultation

Under Regulation 15 of the Neighbourhood Planning (General) Regulations 2012 Hanley Castle Parish Council has submitted the draft Hanley Castle Neighbourhood Plan (Review) to Malvern Hills District Council. In accordance with Regulation 16, the District Council would like to invite comments from organisations and individuals on the draft Neighbourhood Plan from Monday 8 July to 23:59 on Monday 19 August 2024.
Hanley Castle Parish Council undertook consultation on an earlier draft of their Plan between February and March 2023. Comments made during this period helped inform changes to the document now submitted to Malvern Hills District Council. The draft Plan includes 25 policies and proposes four allocations. The draft plan review proposed no changes to policies and site allocations. Where appropriate, additional details have been added and the Plan has been updated for changes in the parish.
It is the responsibility of Malvern Hills District Council to collate all the responses and forward them on to an independent examiner, who will consider the responses and the Plan documents when assessing whether the Neighbourhood Plan meets the relevant legislation and can therefore proceed to referendum.

Regulation 14 Consultation
Under Regulation 14 of the Neighbourhood Planning (General) Regulations 2012 Hanley Castle Council undertook a pre-submission consultation on the draft Hanley Castle Neighbourhood Plan Review before submission under Regulation 15 to Malvern Hills District Council. Hanley Castle Neighbourhood Plan - Adopted 22 January 2019
At its Executive Committee meeting on 22 January 2019 Malvern Hills District Council decided to "make" (adopt) the Hanley Castle Parish Neighbourhood Plan so that it is part of the statutory Development Plan for Malvern Hills District, sitting alongside the South Worcestershire Development Plan and other material consideration in determining planning applications in the parish of Hanley Castle.

Referendum – 29 November 2018
A Referendum on the Hanley Castle Parish Neighbourhood Plan was held on Thursday 29 November 2018. There was a 18.7% turnout, with 81% voting in favour of Malvern Hills using the Hanley Castle Parish Neighbourhood Plan to help it decide planning applications in the Neighbourhood Area.

Examiner's Report - August 2018
Malvern Hills District Council (with the agreement of Hanley Castle Parish Council) appointed Ann Skippers to examine the Hanley Castle Parish Neighbourhood Plan. The Examiner conducted the examination through consideration of written representations.
The Examiner's Report concluded that the Hanley Castle Parish Neighbourhood Plan, subject to the recommended modifications, meets the Basic Conditions and can proceed to referendum. To view the Examiner’s Report, please follow the link below:
During the examination the Examiner requested that Malvern Hills District Council consider whether the HRA Screening Report was legally compliant in light of the judgement of the Court of Justice ruling in the case of ‘People over Wind, Peter Sweetman v Coillte Teoranta’. Submitted Neighbourhood Plan Consultation – 16th February 2018 to 5pm on Friday 6th April 2018
Under Regulation 15 of the Neighbourhood Planning (General) Regulations 2012, Hanley Castle Parish Council submitted the Hanley Castle Parish Neighbourhood Plan to Malvern Hills District Council on 29th January 2018.
In accordance with Regulation 16, Malvern Hills District Council undertook a public consultation from Friday 16th February 2018 until 5:00pm on Friday 6th April 2018, during which interested parties were invited to make comments on the draft Hanley Castle Parish Neighbourhood Plan.
The submitted documentation includes:
- the proposed Neighbourhood Plan
- a map, forming part of the above Plan, identifying the area to which the proposed Neighbourhood Plan relates
- a Consultation Statement explaining who was consulted, and how consultation comments have been addressed
- a Basic Conditions Statement explaining how the proposed Neighbourhood Plan meets the requirements set out in legislation and environmental matters.

Neighbourhood Area Application – Approved 21 July 2014
The District Council designated the parish of Hanley Castle as a Neighbourhood Area, under Regulation 7 of the Neighbourhood Planning (General) Regulations 2012 on 21 July 2014.
Following an application made by the Parish Council in April 2014, the District Council held a six week consultation, which closed on 28th June 2014.
